1. Definitions

Platform: HorseBidder, an online listing platform for horses and related services.

Visitor: any person who visits the website without creating an account.

User: any natural person or legal entity with a registered account.

Seller: a User who posts a Listing.

Buyer: a User who responds to a Listing.

Listing: any listing published on the Platform.

Subscription: a paid package that allows Sellers to post Listings.

2. Applicability

These Terms & Conditions apply to any use of the Platform.

HorseBidder may change these terms at any time. Continued use means acceptance.

3. Access to the Platform

• Visitors can browse freely.
• Contact details are only visible to registered users.
• Interaction is only possible via an account.

4. Role of the Platform

HorseBidder is solely a technical listing platform.

• is not a Seller, Buyer or intermediary;
• is not a party to agreements between users;
• does not facilitate payments or deliveries;

Transactions take place directly between buyer and seller.

4.1 Intellectual Property

All intellectual property rights belong to HorseBidder.

Copying or reuse without permission is prohibited.

5. Accounts

• Users must provide correct information.
• Private and business accounts are available.
• Accounts may be refused or deleted in case of abuse.

6. Subscriptions

• Sellers pay a fixed subscription fee.
• A subscription only grants the right to post listings.
• There is no sales guarantee.
• Subscriptions are non-refundable unless legally required.

7. Listings and Approval

Listings are visually checked in advance.

The check is limited.

Approval is not a guarantee of:

• health or condition;
• accuracy of the description;
• recency of photos;
• suitability for sport or breeding.

The seller remains fully responsible.

8. Non-binding interaction

No purchase obligation arises via the Platform.

Auctions are subject to separate terms.

9. External auctions

Links to external auctions are fully external.

HorseBidder is not responsible.

10. No involvement in transactions

• does not receive purchase funds;
• does not hold payments;
• does not take part in negotiations;
• is not responsible for disputes.

11. Liability

HorseBidder is not liable for transactions between users.

Liability is limited to the lower of:

• the paid subscription price;
• €250.

12. Abuse and fraud

Listings or accounts may be removed in case of abuse.

13. Privacy and Cookies

Personal data is processed according to the Privacy and Cookie policy.

14. Governing law

These terms are governed by Belgian law.
